UPDATE: CANADA POST DELIVERY DELAYS

As a result of the recent Canada Post labour disruption, notices of upcoming Committee of Adjustment meetings may be delayed as delivery of standard mail slowly resumes back to normal. Pursuant to the legislative requirements of the Planning Act, as amended, and as outlined in O.Regs 197/96 and 200/96, respectively, a Notice of Hearing may be provided by posting it, with the time and date of the meeting, on the Township's website.

Committee of Adjustment Meetings are held as HYBRID HEARINGS, with virtual and in-person participation (Council Chambers, King Township Municipal Centre). 

Anyone wishing to view the hearing can visit www.king.ca/meetings 

Please note that viewing the hearing will not provide you with the ability to speak, should you wish to speak to a matter please contact the Secretary Treasurer at COFA@King.ca to request this.

The Committee of Adjustment Agenda containing planning reports, public correspondence and application materials can be found on our website the Friday prior to the hearing by clicking onto the corresponding hearing date found on the online calendar.

Deferrals can be requested by any party and the decision to grant a deferral is at the sole discretion of the Committee of Adjustment.  A deferral request by an applicant/agent that takes place at the hearing, will be subject to an additional re-circulation review fee if granted by the committee.

What is the Committee of Adjustment?

The Planning Act authorizes the Council of The Corporation of the Township of King to appoint members to the Committee who are responsible for hearing applications which consider various matters related to land use. The mandate of the Committee as provided by the Planning Act is to consider planning applications which include: 

  • minor variances
  • consents (severances), easements,  property boundary line adjustments
  • changes to legal, non-conforming uses that current zoning does not permit
  • leases for more than 21 years
  • validation of title

Committee members are to evaluate applications for consistency with the intent of various planning documents including the Greenbelt Plan; the Oak Ridges Moraine Conservation Plan; Provincial Policy Statement (PPS); Township of King Official Plan and Zoning By-laws.

The Committee of Adjustment & Property Standards Committee term runs concurrent with Council.

The Committee of Adjustment meets once (1) every month to hear applications as received and assigned to that month's agenda by the Township.

Please note that applications will be given a file number and will be scheduled in the order of receipt. There is typically a maximum number of 8-10 applications heard at each Committee of Adjustment meeting. Applications not scheduled on a particular meeting will be scheduled to the next available meeting date.

The appeal period for minor variances is 20 days from the date of the Committee’s decision. For consents, the appeal period is 20 days from the date of when the notice is issued. If there are no appeals filed within the appeal period, the decision of the Committee is final and binding.
