• Step 2: Committee of Adjustment Pre-Consultation Meeting

  A Pre-consultation meeting is recommended prior to the submission of a formal Committee of Adjustment application.

  MINOR VARIANCE: Pre-consultation Meeting

  1) Complete the Pre-consultation request form found here:

  2) Attach the following required documents: Minor Variance Zoning Review Letter, Site Plan(s), Drawings, Surveys, Elevations etc. Ensure these are high resolution PDF documents, formatted to a legal sized document. If your files are large in size, please submit your documents by way of a cloud based server (i.e. dropbox, wetransfer, google drive, etc.). 

  3) If you are an agent who has been authorized on behalf of the owner, we require the owner(s) authorization to confirm this. You must have the owners (applicants) complete the PDF form below and attach it to your pre-consultation request form:

  3) Submit payment of your pre-consultation (Minor Variance) meeting online. Fee is $200.00 and can be paid here, link for payment can be found within the pre-consultation form:

• Step 3 : Complete a Formal Committee of Adjustment Application

  Instructions

  Once you have completed your pre-consultation with a member of the Planning Division and have received direction to do so, please fill out a Committee of Adjustment Application Form (Minor Variance or Consent).

   

  A complete submission shall consist of the following:

   

  1. The completed application form including the completion of the site screening questionnaire (page 4 and 5 of the application form)

   

  Please visit the Zoning By-laws and Official Plan pages to fill in the application forms. Please contact the Planner assigned to your application for assistance if required.

   

  2. Ensure your application is Commissioned by a commissioner of oath, a Notary Public or a Lawyer. Town staff is available to Commission your application, please contact the Secretary Treasurer at COFA@King.ca to schedule this.

   

  3. Location map/Survey (to show context of the subject property)

   

  4. Site grading plan (showing existing and proposed grades)

   

  5. Site plan (showing existing and proposed building and structure setbacks, impervious and pervious surface breakdown areas, driveways, walkways, decks, pools, patios, septic tank and fields, roads,  etc. A sample site plan of what must be included on the site plan can be foundhere. 

   

  6. Elevations (north, south, east and west) showing height of all proposed buildings and structures from average finished grade. Example of elevations can be found here

• Step 4: Submit the Application and Fee

  Application Submission

  To submit an application, we are currently only taking electronic submissions. Please send an email to cofa@king.ca with a link (i.e. dropbox, google drive, etc) for us to download and retrieve the document materials. 

   

  Please check the "Complete Application Check List" to ensure all required items are provided. 

   

  An incomplete submission may result in the delay of the processing of your application. 

   

  Fee

  Applicants can now pay their application fees online on the website through the link here.

   

  *Application fees over $10,000 will require processing via cheque (payable to the Township of King) and is to be dropped off in the self-serve area located on the East Wing of the Township Municipal Centre located at 2585 King Road, King City, ON from 8:30 am to 3:00 pm, Monday to Friday. The online system will be unable to process any fees larger than $10,000.00.

   

  2024 Fees for Minor Variance: 

  Minor Variance for As-Built/Post Construction - $4,500.00

  Minor Variance (accessory structures, pools, small additions under 50m2) - $2,538.00

  Minor Variance (new dwelling, additions over 50m2, non-residential) - $3,938.00

   

  Note: There may be Conservation Review Fees and Region of York Fees if the subject property is subject to their jurisdiction.

• Step 5: Sign Pick up

  Once your application has been scheduled for the next available Committee of Adjustment hearing date, staff will contact you directly to pick up your Notice of Public Hearing Sign. 

  The Township will provide each applicant with a yellow Notice of Public Hearing sign which can be picked at the Planning counter on the main level of the Township Municipal Centre located at 2585 King Road, King City, ON from 8:30 am to 4:30 pm, Monday to Friday. 

  As required by the Planning Act, the sign must be erected on the subject property where it can be visibly seen, close to the street, and legible by the public and vehicular traffic.

  The sign must follow the instructions as listed in the guide below and as detailed out in the Sign Pick Up email you receive from the Secretary-Treasurer.

  A picture of the erection of the sign must be provided a minimum of 10 days prior to the date of the meeting date. Please send the photo to cofa@king.ca to satisfy the requirement.  

  Failure to adhere to these requirements may result in the postponement of the application.

• Step 6: Public participation at the Committee of Adjustment hearing

  How to submit Correspondence to the Committee for review and consideration 

  We ask for written correspondence to be submitted by noon on the Friday prior to the scheduled hearing. Written submissions can be emailed to cofa@king.ca , please quote file number in subject line.

  How to register to speak to the Committee at the hearing

  Anyone wishing to speak to the Committee of Adjustment Virtually, must register by contacting the Secretary Treasurer at cofa@king.ca , no later than noon on the Friday prior to the scheduled hearing. When your request to speak is received, a confirmation message and instructions for providing a deputation virtually at the meeting will be provided.

  Anyone wishing to speak to the Committee of Adjustment in-person, should register by contacting the Secretary Treasurer at cofa@king.ca. You may also register at the hearing in Council Chambers by completing a deputation registration form and providing it the Secretary Treasurer.

  Only participants wishing to speak live on the night of the meeting to the Committee of Adjustment members will need to register for the meeting. If you only wish to observe and watch the meeting, but not speak, you can do by clicking the following link:  https://www.king.ca/meetings
