Take Notice that on the 17th day of March, 2025 the Council of the Corporation of the Township of King approved a Draft Plan of Condominium – Common Element submitted by Camcos (King) Inc., under Section 51 of the Planning Act, R.S.O., 1990, and pursuant to the Condominium Act, 1998, with respect to a parcel of land on the northeast corner of Keele Street and Dennison Street in the Village of King City, legally described as Part of Block 2, Registered Plan 65M-4757, and municipally known as 13151 to 13211 Keele Street, King City, Township of King.
Decision Background
Public, Staff and Agency submissions were considered and where applicable, are reflected in the Conditions of Approval and/or Draft Plan of Condominium, which were presented at Council on March 17, 2025.
Draft Plan Approval is subject to 33 conditions as per attached.
Appeal Procedure
Take notice that an appeal to the Ontario Land Tribunal (OLT) in respect to all or part of this Draft Plan of Condominium – Common Element, may be made by filing a notice of appeal, including setting out reasons for the appeal, with the Township Clerk either via the OLT e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting Township of King as the Approval Authority, or by email at clerks@king.ca , no later than 4:30 p.m. on Tuesday, April 22, 2025. Should this date fall on a holiday or weekend, you will have until 4:30 p.m. of the next business day to file your appeal. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. The OLT appeal fee of $1,100 per application being appealed, can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the OLT or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca. If the e-file portal is down, you can submit your appeal to clerks@king.ca.
Any appeals filed with the OLT, must also submit the Clerk’s Department Administrative processing fee of $260.00 per application, and the Planning Division’s Administrative processing fee of $450.00 per application, payable to the Township of King, no later than Tuesday, April 22nd, 2025. These fees may be paid through our online payment portal (www.king.ca/OLT ) , or by forwarding two separate cheques payable in the amounts noted above, to the Township of King, Attn: Township Clerk, 2585 King Road, King City, ON, L7B 1A1.
The decision of the Council of the Corporation of the Township of King is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.
Right of Applicant or Public Body to Appeal Conditions of Draft Plan of Condominium
The applicant, the Minister of Municipal Affairs, or any public body that has made oral submissions at the public meeting or made written submissions to the Council of the Corporation of the Township of King before the proposed Draft Plan of Condominium was approved, may at any time before the approval of the Final Plan of Condominium, appeal any of the conditions imposed by the Council of the Corporation of the Township of King to the OLT by filing a notice of appeal with the Clerk of the Corporation of the Township of King.
No person or public body shall be added as a party to the hearing of the appeal of the decision of the approval authority, including the lapsing provisions or the conditions, unless the person or public body, before the decision of the approval authority, made oral submissions at a public meeting or written submissions to the council, or made a written request to be notified of changes to the conditions or, in the OLT’s opinion, there are reasonable grounds to add the person or public body as a party.
Notice of Changed Conditions of Approval
You will be entitled to receive notice of any changes to the conditions of approval of the Draft Plan of Condominium if you have made a written request to be notified of changes to the conditions.
No person or public body shall be added as a party to the hearing of an appeal regarding any changes to the conditions of approval unless the person or public body, before the approval authority made its decision, made oral submissions at a public meeting, if one was held, or written submissions to the approval authority, or made a written request to be notified of the changes to the conditions or, in the Ontario Land Tribunal’s opinion, there are reasonable grounds to add the person or public body as a party.
No person or public body shall be added as a party to the hearing of the appeal of the decision of the approval authority, including the lapsing provisions or the conditions, unless the person or public body, before the decision of the approval authority, made oral submissions at a public meeting or written submissions to the council, or made a written request to be notified of changes to the conditions or, in the Ontario Land Tribunal’s opinion, there are reasonable grounds to add the person or public body as a party.
