Take Notice that on the 18rd day of October, 2024 the Council of the Corporation of the Township of King approved an application for Phase 3 of a Draft Plan of Subdivision under Section 51(37) of the Planning Act, R.S.O., 1990, with respect to the following application:

The Draft Plan of Subdivision application under File No. 19T-12K01 concerns lands legally described as Part of Lot 6, Concession 9, Village of Nobleton, Township of King, as shown on the attached map. The overall area which the subject application consists of is north of King Road and west of Highway 27. The applicant for the subject lands is Fandor Homes. The subject lands are subject to site-specific Zoning By-laws 2017-08 and 2017-09 (File No. Z-2012-01).

Decision Background

All submissions were considered as part of the decision making process.  Public, Staff and Agency submissions were considered and where applicable, are reflected in the Conditions of Approval and/or draft plans and Zoning By-law. Public consultation on the Draft Plan of Subdivision took place in the form of a public open house on June 14, 2012 and a formal statutory Public Meeting under the Planning Act on November 12, 2012.  All comments received were considered in Municipal Planning staff reports and were made available to the public.

Appeal Procedure

Take notice that an appeal to the Ontario Land Tribunal (OLT) in respect to all or part of this Zoning By-law Amendment may be made by filing a notice of appeal with the Township Clerk either via the OLT e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting Township of King as the Approval Authority or by email at clerks@king.ca , no later than 4:30 p.m. on Thursday, November 21st, 2024. Should this date fall on a holiday or weekend, you will have until 4:30 p.m. of the next business day to file your appeal.  The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal fee of $1,100 per application being appealed, can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the OLT or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca. If the e-file portal is down, you can submit your appeal to clerks@king.ca.

Any appeals filed with the OLT, must also submit the Clerk’s Department Administrative processing fee of $250.00 per application, and the Planning Division’s Administrative processing fee of $412.00 per application, payable to the Township of King, no later than Thursday,  November 21st, 2024. These fees may be paid through our online payment portal (www.king.ca/OLT ) , or by forwarding two separate cheques payable in the amounts noted above, to the Township of King, Attn: Township Clerk, 2585 King Road, King City, ON, L7B 1A1.

The decision of the Council of the Corporation of the Township of King is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Right of Applicant or Public Body to Appeal Conditions of Draft Plan of subdivision

The applicant, the Minister of Municipal Affairs, or any public body that has made oral submissions at the public meeting or made written submissions to the Council of the Corporation of the Township of King before the proposed Draft Plans of Subdivision was approved, may at any time before the approval of the Final Plan of Subdivision, appeal any of the conditions imposed by the Council of the Corporation of the Township of King to the OLT by filing a notice of appeal with the Clerk of the Corporation of the Township of King. 

No person or public body shall be added as a party to the hearing of the appeal of the decision of the approval authority, including the lapsing provisions or the conditions, unless the person or public body, before the decision of the approval authority, made oral submissions at a public meeting or written submissions to the council, or made a written request to be notified of changes to the conditions or, in the OLT’s opinion, there are reasonable grounds to add the person or public body as a party.

Notice of Changed Conditions of Approval

You will be entitled to receive notice of any changes to the conditions of approval of the proposed plan of subdivision if you have made a written request to be notified of changes to the conditions.

No person or public body shall be added as a party to the hearing of an appeal regarding any changes to the conditions of approval unless the person or public body, before the approval authority made its decision, made oral submissions at a public meeting, if one was held, or written submissions to the approval authority, or made a written request to be notified of the changes to the conditions or, in the OLT’s opinion, there are reasonable grounds to add the person or public body as a party.

Notice Requirements For Landlords & Condominium Corporations

In accordance with Ontario Regulation 197/96 if you own a building that contains more than 7 (seven) residential units, you must post this public notice in a location that is visible to all residents within your building. In accordance with the Condominium Act, a corporation that is served with a notice under the Planning Act shall notify all persons whose names are in the record of the corporation maintained under subsection 47 (2) and shall make a copy of the notice available for examination.
