Take Notice that the Council of the Corporation of the Township of King passed By-law Number 2024-080 on the 15th day of October, 2024 under Section 34 of the Planning Act, R.S.O, 1990.
Take Notice that an appeal to the Ontario Land Tribunal (the Tribunal) in respect to all or part of this Zoning By-law Amendment may be made by filing a notice of appeal with the Township Clerk either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting Township of King as the Approval Authority or by email at clerks@king.ca , no later than 4:30 p.m. on Monday, November 18th , 2024. Should this date fall on a holiday or weekend, you will have until 4:30 p.m. of the next business day to file your appeal. Appeals filed after 4:30 p.m., either in person or electronically, will be deemed received on the next business day. The appeal fee of $1,100 per application being appealed, can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Tribunal or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca. If the e-file portal is unavailable, you can submit your appeal to clerks@king.ca.
Any appeals filed with the Tribunal, must also submit the Clerk’s Division Administrative processing fee of $250.00 per application, and the Planning Division’s Administrative processing fee of $412.00 per application, payable to the Township of King, no later than 4:30 p.m. on Monday, November 18th, 2024. These fees may be paid through King’s online payment portal at (www.king.ca/OLT), or by forwarding two separate cheques payable in the amounts noted above, to the Township of King, Attn: Township Clerk, 2585 King Road, King City, ON, L7B 1A1.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Tribunal there are reasonable grounds to add the person or public body as a party.
The subject land is also the subject of Notice of passing of By-law Number 2024-079, a by-law to adopt Amendment No. 4 to the Official Plan of the Township of King, and applications for consent, file numbers B-24-03 and B-24-04.
Comments received and considered in the preparation of the By-law 2024-080 from the public were summarized and included in the Planning Division Recommendation Report (GMS-PL-2024-011). The report is available on the Township’s website www.king.ca . Comments received in relation to the density of the proposed development and alternative forms of higher density residential development were provided at the public meeting and addressed in Report GMS-PL-2024-11. All comments received were considered in municipal planning staff reports and were made available to the public both on our website (www.king.ca ) and in person. The comments were identified, discussed, and where appropriate, were addressed at the Council meeting on April 29, 2024, and within Planning Division Report No.’s GMS-PL-2024-011. The report is available on the Township’s website www.king.ca. More specifically, based on these comments, Council is satisfied that all matters have been appropriately addressed.
An explanation of the purpose and effect of the By-law and a key map showing the location of the lands affected by the By-law are attached and are on our website at www.king.ca (File No. Z-2023-09).
The decision of the Council of the Corporation of the Township of King is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Explanatory Note Re: By-law 2024-080
By-law Number 2024-080 concerns two parcels of land, municipally known as 31 and 37 Banner Lane, located on the east side of Banner Lane, south of King Road. The subject properties measure approximately 1,926 m2 and 1939 m2 respectively and currently support one single detached dwelling on each property.
By-law 2024-080 rezones the subject properties from Residential – Single Detached “C”- ‘R1C’ TO Residential – Single Detached “C”, Exception 6.5.4.5 – HOLDING (H) (R1C-5-H) to facilitate the creation of one new residential lot that is to contain a single detached dwelling. The zoning by-law amendment introduces site-specific provisions to establish the requirements for: minimum lot area, interior side yard setback, and maximum lot coverage.
The by-law also attaches a Holding (H) zone provision to the lands to address the timing of development in respect to confirming and assigning both water and sanitary capacity for the proposed development. As part of the Holding (H) zone provisions, a Development Agreement is to be executed between the Township of King and the owner(s) of the Lands for the purposes of, but not necessarily limited to, the following: site layout; landscaping and compensation plantings; grading; site drainage; and site servicing.
